H. S Phoolka's reaction on statement by Harsimrit Kaur Badal

 The statement of Harsimrat Kaur Badal, Cabinet Minister, that Modi Government would implement the Report of Nanavati Commission to punish the guilty, is highly surprising.

Nanavati Commission submitted its report in February 2005 and was tabled in the Parliament on August 8, 2005.

In this Report, Nanavati Commission had recommended registration of only 4 cases which are against Sajjan Kumar, Jagdish Tytler. All these 4 cases were registered and investigated by the CBI. Nanavati mentioned in his report that 241 cases are closed by Police and were never sent for trial to Courts. But, unfortunately it recommended reopening of only 4 cases. Other 237 cases, Nanavati never recommended to be reopened. Justice could only be done and the guilty could be punished if these 237 cases are reopened. For this purpose Kejriwal government had constituted SIT to reopen and reinvestigate these 237 cases which are closed by Police and never sent for trial. The SIT has not been made functional yet. The Modi government should immediately make the SIT functional and get these 237 cases reinvestigated.

The details of 4 cases recommended by Nanavati Commission are as follows:-

1)    Police Station- Delhi Cantt.- Against Sajjan Kumar- Ex-MP, Mahinder Yadav-Ex-MLA, Balwant Khokhar-Ex-Councillor and 3 others.

The case was registered in 2005 and the chargesheet was filed in January 2010. Trial took 3 years to complete. Trial Court finally decided the matter on April 30, 2013. Sajjan Kumar was acquitted, Mahinder Yadav- Ex MLA was convicted and Balwant Khokhar- Ex Councillor was also convicted. Appeals are pending in High court. The bail of Balwant Khokhar- Ex Councillor was listed in Delhi HC today. The matter has now been adjourned for July 07, 2014. He is in the jail.

2)    Sultanpuri Police Station- Against Sajjan Kumar and 4 others- Chargesheet was filed in January 2010, the case is still pending before the Trial Court and evidence of witnesses is still going on in Karkardooma Court.

3)    Mangolpuri Police Station- Against Sajjan Kumar. The eye witness Dr. Iqbal Singh died long time back, therefore, this case was closed.

4)    Bara Hindu Rao, Police Station- Against Jagdish Tytler- Case was registered by CBI in October 2005. After investigation the CBI filed the Closure Report which is rejected by the Court and the case is pending for investigation with the CBI now. Jagdish Tytler has challenged the order of Add. Sessions Judge rejecting the closure report of CBI and reopening the case. His appeal is listed on May 29, 2014 in Delhi High Court.

For rehabilitation, Prime Minister Package was declared in January 2006. This has not been completely implemented. This Package included giving jobs in each family of victims. Modi government should implement this package and provide job to the victims.
