H. S Phoolka's reaction on statement by Harsimrit Kaur Badal

84 RIOTS: STATEMENT OF CABINET MINISTER IN MODI GOVERNEMNT
Smt. Harsimrat Kaur Badal taking charge as the Union Minister for Food Processing Industries on May 27, 2014.
श्रीमती हरसिमरत कौर बादल 27 मई, 2014 को नई दिल्ली में केन्‍द्रीय खाद्य प्रसंस्‍करण उद्योग मंत्री के रूप में कार्यभार संभालते हुए
The statement of Harsimrat Kaur Badal, Cabinet Minister, that Modi Government would implement the Report of Nanavati Commission to punish the guilty, is highly surprising.

Nanavati Commission submitted its report in February 2005 and was tabled in the Parliament on August 8, 2005.
Courtesy Photo
In this Report, Nanavati Commission had recommended registration of only 4 cases which are against Sajjan Kumar, Jagdish Tytler. All these 4 cases were registered and investigated by the CBI. Nanavati mentioned in his report that 241 cases are closed by Police and were never sent for trial to Courts. But, unfortunately it recommended reopening of only 4 cases. Other 237 cases, Nanavati never recommended to be reopened. Justice could only be done and the guilty could be punished if these 237 cases are reopened. For this purpose Kejriwal government had constituted SIT to reopen and reinvestigate these 237 cases which are closed by Police and never sent for trial. The SIT has not been made functional yet. The Modi government should immediately make the SIT functional and get these 237 cases reinvestigated.

The details of 4 cases recommended by Nanavati Commission are as follows:-

1)    Police Station- Delhi Cantt.- Against Sajjan Kumar- Ex-MP, Mahinder Yadav-Ex-MLA, Balwant Khokhar-Ex-Councillor and 3 others.

The case was registered in 2005 and the chargesheet was filed in January 2010. Trial took 3 years to complete. Trial Court finally decided the matter on April 30, 2013. Sajjan Kumar was acquitted, Mahinder Yadav- Ex MLA was convicted and Balwant Khokhar- Ex Councillor was also convicted. Appeals are pending in High court. The bail of Balwant Khokhar- Ex Councillor was listed in Delhi HC today. The matter has now been adjourned for July 07, 2014. He is in the jail.

Mr. H.S Phoolka, Senior Advocate appeared in the High court in this matter today on behalf of the victims.

2)    Sultanpuri Police Station- Against Sajjan Kumar and 4 others- Chargesheet was filed in January 2010, the case is still pending before the Trial Court and evidence of witnesses is still going on in Karkardooma Court.

Mr. H.S Phoolka, Senior Advocate is representing the victims.

3)    Mangolpuri Police Station- Against Sajjan Kumar. The eye witness Dr. Iqbal Singh died long time back, therefore, this case was closed.

4)    Bara Hindu Rao, Police Station- Against Jagdish Tytler- Case was registered by CBI in October 2005. After investigation the CBI filed the Closure Report which is rejected by the Court and the case is pending for investigation with the CBI now. Jagdish Tytler has challenged the order of Add. Sessions Judge rejecting the closure report of CBI and reopening the case. His appeal is listed on May 29, 2014 in Delhi High Court.

Mr. H.S Phoolka, Senior Advocate is representing the victims.

For rehabilitation, Prime Minister Package was declared in January 2006. This has not been completely implemented. This Package included giving jobs in each family of victims. Modi government should implement this package and provide job to the victims.

Ludhiana: 26th may 2014: (Punjab Screen Bureau):
Associate Banks' Officers' Association today held a Dharna in front of State Bank of Patiala, Zonal Office, Ludhiana on the following issues:-

• Framing of unwarranted DPD cases against officers and making these cases as vigilance angle cases without going into merits of the case.
• Violation of Transfer policy of officers.

Com. On the occasion, Com. SRI LANKA: Deaths in police custody are of serious concern

Fri, May 23, 2014 at 8:39 AM
A Press Release from the Standing Committee on Rule of Law, Bar Association of Sri Lanka forwarded by the Asian Human Rights Commission (AHRC)
Series of deaths of persons in police custody as suspects regarding the commission of criminal offences is of serious concern. The identical explanations given by the police regarding each such case of death while in custody and acceptance of such blatant manifest untruths has made a mockery of the system of administration of justice in our country. It is an insult to the intelligence of our people if the police expect the people to believe these fantasy stories about attacks on them by suspects while in custody and handcuffed.
What is strange is that these cases of brutal murder has gone unchecked and the absurd explanations given by the police has gone unchallenged.
These killings violates all international conventions on protection of persons in state custody and is in violation of the right to life as proclaimed in the Universal Declaration of Human Rights. It is enshrined in our constitution that every person is presumed to be innocent till proved guilty by a competent court (Article 13(5)), no person shall be punished with death or imprisonment except by order of a competent court (Article 13(4)), any person charged with an offence is entitled to be heard at a fair trial by a competent court (Article 13(3)), any person shall not be held in custody, detained or deprived of personal liberty except upon order of a judge made in accordance with procedure established by law (Article 13(2)).
While these murders are in violation of the constitution what is of grave concern is the impunity with which these murders are committed. In no country that respects rule of law and democratic governance can these acts be condoned under any circumstances and the responsibility lies with the state to account for these violations of fundamental rights.
Failure to act decisively against such persons responsible for the commission of these crimes, adversely affect the image of our country and the people lose faith in the judicial system of our country. Nothing short of a full inquiry by a commission of inquiry to be constituted of present or retired judges of the Superior Courts can redeem the image of the country and restore confidence in the administration of justice. Therefore we demand the appointment of such a judicial commission to inquire and report on the deaths of suspects under police custody during the last at least 3 years.

Unlawful demolition of 130 homes, 600 rendered homeless

Ghar Bachao Ghar Banao Andolan
Slum dwellers start Satyagraha asserting their right to shelter: AAP to support
Mumbai: 20 May 2014: (Punjab Screen Bureau):
National Alliance of People’s Movements (NAPM) condemns the unlawful eviction of 600 people and brutal demolition of 130 homes that took place at 90 ft. Road, Dr. Babasaheb Ambedkar Nagar, Mulund (E), Mumbai yesterday, May 20th.

In January 2013, Maharashtra Chief Minister Prithviraj Chavan had set up an enquiry commission to curb corrupt practices plaguing 6 SRA (Slum Rehabilitation Authority) projects and Re-development plans in slum areas of Mumbai after local residents had exposed the irregularities. The commission was led by Mr. Debashish Chakrabarty, Principal Secretary (Housing).

It is after 1 year and 5 months of investigation that Mr Chakrabarty submitted his report to  Chief Minister in which it is concluded that the slum dwellers should approach the Additional Collector for getting the eligibility issue resolved, and for other issues they are asked to submit their application to the SRA who would give an hearing and settle the issues. All this is yet to happen. It is also not clear that whether the CM has approved the report however the report is recently received by NAPM and the NAPM was to act on the same. It is therefore absolutely unjustifiable that the houses are demolished without serving the purpose of the enquiry itself.

While the enquiry is extra-ordinarily delayed, Samarth Spark Developers have used this opportunity to their own advantage, which is grabbing land by displacing the poor. First, they have cleverly manipulated the law by prompting Ashtabhuja Society to file a case against them (vide writ petition 647/2014 date. 03.04.2014) as a result of which the High Court has ordered demolition of these houses. Whether the court was kept in dark about the enquiry commission or not, its judgement has led to the demolition even before the enquiry’s final findings. Then, in cahoots with the local administration, they’ve carried out the demolition before the victims could take recourse to law.

Demolitions were carried out in the early hours of morning by Tehsildar Smt. Dalvi under direct orders from Deputy Collector Ravi Patil.

Out of the 136 demolished homes, 16 were unsurveyed and hence didn’t qualify for demolition.

Out of the demolished houses 111 didn’t qualify under the 1/1/95 cut-off for slum dwellings  but they were to be in the process of getting declared as eligible since the government had decided to increase the 95 cut-off to the year 2000. [‘Free housing for slumdwellers till 2000’ |TNN | Jan 3, 2012]. The Deputy Collector was well-informed about this process but went ahead with the demolitions showing clear bias for the builder fraternity at the cost of urban poor. It is thus clear that the election promises to the urban poor in Mumbai have already forgotten and the politicians are back to their unjustice & illegal practices.

Ten households which were legal structure, but had denied rehabilitation in transit camps were also evicted. Their inability to move into the transit camp was again an administrative blunder as the camp was situated on disputed land (public playground). In any case the transit camp are in a very bad condition and while others are compelled to stay there this households had demanded a legal and liveable transit accommodation. Such high-handedness is unacceptable in any civilized society and can only lead to further disenchantment of the people from administrative machinery and alienation from recourse to law. Other households have been demanding their inclusion in the housing scheme of ashtabhuja society as project affected person (PAPs) since this was accepted by the ashtabhuja society when they were granted the land for the housing project inspite of about 600 families living on the land at the time of allotment.

Ms Medha patkar had called and spoken to Chief Minister asking him to intervene in the matter and not to permit eviction and demolition of houses till the process of enquiry is completed and justice is assured. He had promised to do the same but with no avail.

Eviction notices were handed out on 19th May, 2014 at 1 PM. Showing exemplary promptness and utmost loyalty to their builder benefactors, officials carried out demolitions much before the stipulated deadline of 24 hours was over. At 9.30 AM, 600 families including children, senior citizens and a large number of women were thrown on the streets. Their personal possessions lie buried in the rubble, and in the scorching heat and an impending monsoon, all these citizens of Mumbai have been cruelly left at the mercy of nature.

In the past 11 years, SRA plans have shown little progress. The CAG report for Maharashtra (Civil) dated 31st march 2011 clearly indicates the failure of this scheme.

It is important for media to note the fact that in the past, Chief Promoter of the SRA – Moreshwar Koli and aides of Samarth Spark Developers led by Dattaji Desai and Raju Salve have taken violent measures to take over the land. They are responsible for not just intimidation, but goons were hired on 10th July, 2011 to inflict serious assault on members of Ambedkar Basti.

At this hour of extreme injustice, we seek the support of all citizens of this country who believe in the basic right of shelter for all human beings. Demolition is an act of violence with official sanction; its victims are poor who are living in shanties not out of choice. By criminalizing hard-working women and innocent children, Mumbai will only become a city but without a heart.

Solar Salt

20-May-2014 16:25 IST
Special feature on Regional Sidelines                                   --M.V.S. Prasad*
Common salt touches the lives of almost everyone. Indian salt industry has made rapid strides during last six decades. From an import dependent nation at the time of Independence, today it ranks third amongst 120 salt producing countries, with an average annual production of about 24 million tonnes. The Indian Salt Industry after meeting country's domestic requirements of 18 million tonnes, exports about five million tons of salt to 20 countries.

Out of the total of salt produced in the country annually, 70% salt is produced from sea brine and 28% salt comes from subsoil brines and the remaining 2% is produced from lake brines/salt rocks. Mandi in Himachal Pradesh is the only source of rock salt in India. In India, Gujarat, Tamil Nadu and Rajasthan contribute to about 96% of the country's salt production. Gujarat contributes 75% to the total production, followed by Tamil Nadu (11%) and Rajasthan (10%). Other states such as Andhra Pradesh, Maharashtra, Orissa, Karnataka, West Bengal, Goa, Himachal Pradesh, Diu & Daman also contribute to a small extent. About 62% of the total production is from large salt producers, 28% is contributed by small scale producers and rest by medium scale producers. Most of the salt is produced by private sector only. The Indian salt industry uses labour intensive technology in contrast to high level of mechanization in salt industry of nations like Australia, Canada, France, USA etc. India exports surplus production of salt to the tune of about 35 lakh tonnes on an average. Major countries importing salt from India are Japan, Bangladesh, Indonesia, South Korea, North Korea, Malaysia, U.A.E., Vietnam, Qatar etc.

Nearly 30% of total salt produced goes for human and animal consumption and thus can be a potential carrier of essential micronutrients for combating various diseases normally occurring from deficiency of such nutrients in human body. Salt is also required as a basic feedstock in many of the chemical industries. Worldwide about 60% of the salt produced is used in chemical industry, mostly for producing chlorine, caustic soda and soda-ash which are further utilized in the processes like, organic synthesis, polymer and petrochemicals and petroleum refining etc. and is also required in applications such as de-icing, water treatment or coolants etc.

The salt content in the oceans is 'virtually inexhaustible.' Besides this there are substantial deposits of salt in major salt producing countries. There are mainly three ways of producing salt (a) direct mining of rock salt, (b) forced evaporation of brine, and (c) solar evaporation of brine. The most common and energy efficient method is progressive evaporation and concentration of sea, subsoil or lake brines in various condensing and crystallizing pans utilizing solar energy.

In general, purer the salt the more valuable it is. Moisture in salt, mainly due to the presence of excess impurities of magnesium salts, is also detrimental as it can lead to the caking up of salt besides being an unwanted baggage during transportation of salt. For example, if 10 million tonnes of salt has to be transported from the fields by road, a 4% moisture level in salt would amount to ca. 40,000 unnecessary trips! A dry salt thus helps reduce the carbon footprint.

Over the years a series of inventions have taken place in the area of solar salt. CSIR-Central Salt & Marine Chemicals Research Institute, a premier salt research institute has made a commendable contribution in the development of novel cost effective technologies of high purity solar salt production.

The Indian salt industry in general lacks adoption of novel methods of solar salt production leading to inferior quality of harvested salt than countries such as Australia and Mexico. Improving the quality of such impure salt requires mechanical washing and other chemical treatments. CSIR-Central Salt & Marine Chemicals Research Institute, along with various State Governments and Salt Department, the Government is continuously pursuing the programmme of improving the quality of solar salt in a cluster development fashion as well as in the form of establishment of model salt farms which serve as demonstration units among the salt producers.

Mechanization/modernization of solar salt works and use of saline wastes of various industries during solar salt production will also lead to enhancement in salt productivity. The latter will help not only in improving yield but also in improving the quality of slat and mitigation of environmental hazards generally occurred from discharge of effluent in sea or other at other places. Heavy losses in salt production are incurred as a consequence of unfavourable climatic conditions like heavy rainfall etc. Such issues can be addressed partially by mechanization and automation of solar salts. The mechanization of salt works will not only help in overcoming the problems of shortage of desired manpower engaged in salt production activities but will also help in improving the quality and yield of solar salt.

Indian salt industry is targeting production of 40 million tons salt by 2020 to meet its domestic requirement of 25 million tons an export about 10 million salt. It can be achieved by effective utilization of the available 6.1 lakh acre land and increasing productivity using modern technology. The slat industry is to be mechanized, merger of the salt works to increase the size of operation and use of solar plant in place of traditional electric / diesel power is to be encouraged.

PM’s Address to the Nation

17-May-2014 10:17 IST
I am confident about the future of India
Following is the text of Prime Minister, Dr. Manmohan Singh’s address to the Nation:

My Fellow Citizens,

I address you today for the last time as Prime Minister of India.

Ten years ago, when I was entrusted with this responsibility, I entered upon it with diligence as my tool, truth as my beacon and a prayer that I might always do the right thing.

Today, as I prepare to lay down office, I am aware that well before the final judgment that we all await from the Almighty, there is judgment in the court of public opinion that all elected officials and governments are required to submit themselves to.

Fellow citizens, each one of us should respect the judgement that you have delivered. The just concluded elections have deepened the foundations of our democratic polity.

As I have said on many occasions, my life and tenure in public office are an open book. I have always tried to do my best in serving this great nation of ours.

In the last ten years, we as a country have seen many successes and achievements that we should be proud of. Today, India is a far stronger country in every respect than it was a decade ago. I give credit for these successes to all of you. However, there is still vast latent development potential in our country and we must collectively work hard to realize it.

As I leave office, my abiding memory will be the love and kindness that I have always received from you. I owe everything to this country, this great land of ours where I, an underprivileged child of Partition, was empowered enough to rise and occupy high office. It is both a debt that I will never be able to repay and a decoration that I will always wear with pride.

Friends, I am confident about the future of India. I firmly believe that the emergence of India as a major powerhouse of the evolving global economy is an idea whose time has come. Blending tradition with modernity and unity with diversity, this nation of ours can show the way forward to the world. Serving this nation has been my privilege. There is nothing more that I could ask for.

I wish the incoming government every success as it embarks on its task and pray for even greater successes for our nation.

Thank you. Jai Hind.

An address tag used on the Control Unit found on road
Dear Friends,

We wish to bring a shocking incident to your notice. An address tag used on the Control Unit used at Polling Station No.29 at Shivajinagar / Mankhurd assembly segment of the Mumbai North East Parliamentary constituency was found on the road at Shivajinagar today. This address tag is an important identifier of the machine used on the day of polling and the tag being found on the road indicates that the machine could have been tampered with before being transported to the place of storage after the elections. We have already filed a complaint with the Returning Officer and urged him not to start counting in this booth till thorough investigation is done in this matter.  A copy of our complaint and the picture of the tag is being sent to you.

Regards,

Medha Patkar

Pledge to fight for a society based on justice and equality

Wed, May 14, 2014 at 5:05 PM
Homage to Martyrs Com Gurmail Singh Hunjan and Com Joginder Singh
PandherKhedi: (Ludhiana): 14 may 2014: (Punjab Screen Bureau):
The Communist Party of India (CPI) has flayed the Akali - BJP Government in Punjab for its promotion of the mafia of various types and blatant intervention in the police affairs which has led to deterioration of law and order in the state. The latest case of acquittal of all the culprits in the Sarabha Nagar shoot out case has thoroughly exposed the government and the role of police, because of which people involved in public shootout be acquitted even though the two groups reached a compromise. This public shootout threatened the lives of innocent people therefore the people involved should have been booked under relevant IPC act. This was stated by several speakers addressing the gathering on the occasion of 25th martyrdom anniversary of Com Gurmail Singh Hunjan and Com Joginder Singh who fought against separatist designs of Khalisatni terrorists and laid down their lives for integrity and sovereignty of the country, a mammoth public meeting was organised under the president ship of Mrs.Harbans Kaur at their native village Pandher Kheri, Block Dehlon, Distt. Ludhiana where like previous years thousands of people gathered  to pay homage to the beloved leaders. While paying homage Com Com Bant Singh Brar- Punjab State Secretary CPI praised the glorious role of comrades in Punjab who did not care for their lives to save integrity of the nation during the days of terrorism in Punjab. He cautioned that similar danger signals are appearing again. It is a serious matter that the present Akali BJP government is completely ignoring such development and sheltering such elements. Com Brar further cautioned said that communists have dual challenge of fighting fundamentalism as well as struggle for socio economic justice. After the neoliberal economic policies the working class, peasantry and other toiling masses are hit hard due to job freeze, under employment, insecurity of jobs, violation of labour laws with impunity, rising prices of essential items and inability to afford the high cost of health and education. The super rich are being given subsidies while the govt. is taking away all subsidies from the poor people.  In Punjab, he said, the public sector is being scuttled blatantly. Referring to the transport he said he said that whereas the govt. run buses are being run on non profit timings, the private buses owned by the CM and his kins are being given tax concessions and highly profitable timings causing immense loss to the exchequer. As a result of the neo liberal policies promoting mad race for money there are occurring scams of  unprecedented level.

Com Kartar Singh Bowani – Distt. Secretary CPI said that the deteriorating law and order situation in Punjab is a very serious matter. He expressed deep concern at the falling economic condition of the farmers in Punjab leading to suicide by them. Others who paid tribute to the martyrs include Dr.Arun Mitra, Com O.P.Mehta, S.Tej Parkash Singh, S. Malkit Dakha, S. Lakhvir Singh Lakha, Com.Gulzar Goria, Amar Singh Bhattian, Mewa Singh-Raikot, Bhagwan Singh-Maloud, Com D.P.Maur, Dr.Gulzar Pandher, Principal Jagjit Singh, Com.Paramjit Sehora, Com.Kulwant Singh Hunjan also gave tribute to the martyrs. The meritorious school students were awarded. School children recited patriotic poems. Revolutionary songs were presented.

CICU Condemns the Proposal of PSPCL

Sat, May 10, 2014 at 5:15 PM
Imposing Power Cuts and Seeking Hike in Power Tariff will have negative impact
Ludhiana: 19 May 2014: (Punjab screen Bureau):

Sh. Avtar Singh, President CICU said that the proposal of PSPCL for Imposing Power Cuts and seeking hike In Power Tariff submitted to PSERC is uncalled for which will have negative impact on the industry as the cost of production will go up subsequently and lead the industry uncompetitive. This unrealistic proposal is contrary to the tall claims of power surplus Punjab repeatedly being announced by PSPCL. Besides inconvenience to power consumers, the hike in power tariff will be burdening industrial and domestic sectors at the cost of providing free electricity to agriculturalists. Punjab is now a power surplus state therefore should provide power at reasonable rate with other States in India.

Hiking power tariff every year to provide free electricity to farmers cannot be justified as MSMEs are also reeling under adverse economic scenario. All policies framed by PSPCL are anti industry and the industrialists of Punjab are being supplied power at exorbitant rate as compared with all other Northern States. One cannot hope that any new industry will come up in the State due to repeated hike in power tariff and imposition of power cuts.

Sh. Upkar Singh Ahuja General Secretary said that losses of PSPCL are mainly attributable to deficiencies in financial management, planning, implementation of projects, running their operations and monitoring and losses can be minimized or eliminated with better management. He has requested and urged upon Chairman Punjab State Energy Regulatory Commission not to grant permission to PSPCL for hike in power tariff which is bound to fuel inflation and prices northward, so as to save the Punjab industry from disaster and further exodus to adjoining states having pro industrial policies.

CICU requests and urges upon Hon’ble Chief Minister, Sh. Parkash Singh Badal to advise Chairman PSERC not to grant approval for the proposal of PSPCL for seeking hike In Power Tariff so as to encourage investments from other States in Punjab and to boost existing industry.
